Acceptance of Terms
By accessing or using TucsonArtisans.com (“the Site”), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Site. TucsonArtisans.com reserves the right to update these terms at any time without prior notice. Continued use of the Site following any changes constitutes your acceptance of the revised terms.
User Accounts
To submit a listing or event on TucsonArtisans.com, you must create a free account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration. TucsonArtisans.com reserves the right to suspend or terminate any account at our sole discretion, including accounts that violate these Terms and Conditions.
Listing Submissions
TucsonArtisans.com provides a free platform for Tucson-based artists, artisans, makers, and creative businesses to submit directory listings. By submitting a listing you agree that:
- All information provided is accurate and truthful
- You are the authorized representative of the business being listed
- Your listing relates to art, handmade goods, creative services, or the arts community in Tucson, Arizona
- TucsonArtisans.com reserves the right to approve, reject, edit, or remove any listing at our sole discretion without notice
- Listings must not contain false, misleading, offensive, or inappropriate content
Event Submissions
TucsonArtisans.com allows registered users to submit local art events, craft fairs, gallery openings, studio tours, and artisan markets. By submitting an event you agree that:
- The event is real, accurate, and located in or around Tucson, Arizona
- You are authorized to promote the event
- TucsonArtisans.com reserves the right to approve, reject, edit, or remove any event listing at our sole discretion
- TucsonArtisans.com is not responsible for any changes, cancellations, or issues related to submitted events
Header Photo Contest
TucsonArtisans.com may periodically run a monthly header photo contest (“the Contest”), open to artists and businesses with an active listing on the Site. By submitting a photo to the Contest, you agree that:
- You must have an active, approved listing on TucsonArtisans.com to be eligible to enter
- You are the sole creator and rights holder of the photo you submit, and you have full authority to grant the rights described below
- Submitted photos must meet any format, size, and content guidelines posted with the Contest entry form at the time of submission
- Entries must be submitted before the posted monthly deadline; TucsonArtisans.com reserves the right to set, change, or extend entry deadlines at its sole discretion
- TucsonArtisans.com selects the Contest winner(s) at its sole discretion, and all decisions are final
- If selected, your submitted photo may be displayed as the Site’s homepage header image, and/or featured across TucsonArtisans.com’s social media channels (including Facebook, Instagram, and TikTok), for a period of approximately one month
- If selected, your listing may also be marked and displayed as a “featured” listing on the Site’s homepage for the duration of that period
- By submitting a Contest entry, you grant TucsonArtisans.com a non-exclusive, royalty-free, worldwide license to display, distribute, and promote the submitted photo on the Site and on TucsonArtisans.com’s social media channels, in connection with the Contest and general promotion of TucsonArtisans.com
- The Contest is free to enter, and no purchase is necessary
- TucsonArtisans.com reserves the right to modify, suspend, or discontinue the Contest at any time without notice
User Content
By submitting any content to TucsonArtisans.com including listings, events, photos, descriptions, and reviews, you grant TucsonArtisans.com a non-exclusive, royalty-free, worldwide license to display, distribute, and promote that content on the Site and associated social media channels. You retain ownership of your content. You are solely responsible for ensuring you have the rights to any content you submit, including photographs and written descriptions.
Prohibited Content
Users may not submit any content that:
- Is false, misleading, defamatory, or fraudulent
- Infringes on any copyright, trademark, or intellectual property rights
- Contains offensive, hateful, discriminatory, or inappropriate material
- Promotes illegal activities or services
- Contains spam, unsolicited advertising, or irrelevant commercial content
- Impersonates any person, business, or organization
- Is unrelated to the Tucson arts, handmade, or creative community
TucsonArtisans.com reserves the right to remove any content that violates these guidelines without notice.
Advertising & Sponsorship
TucsonArtisans.com offers advertising and sponsorship opportunities to businesses wishing to reach Tucson’s arts and handmade community. All advertising is clearly identified as featured listings. Advertisers do not influence editorial content or directory listings. TucsonArtisans.com reserves the right to refuse any advertising at our sole discretion. Advertising rates and terms are provided upon request and are subject to change.
Donations
TucsonArtisans.com accepts voluntary donations through PayPal to help support the operation of the Site. Donations are entirely optional, are not required to create a listing, submit an event, or enter the Contest, and do not entitle the donor to any special treatment, featured placement, or guaranteed outcome on the Site. All donation transactions are processed directly by PayPal and are subject to PayPal’s own terms and privacy policy. Donations are non-refundable except as required by law.
Web Design Services
TucsonArtisans.com does not offer web design services. Cindy Lee Marketing offers website design including 3-page WordPress websites for Tucson artists and artisans. Web design services are subject to separate service agreements and contracts provided at the time of engagement. These Terms and Conditions do not constitute a service agreement for web design work. TucsonArtisans.com makes no guarantees regarding specific results from any website designed or developed through our services.
Intellectual Property
All content on TucsonArtisans.com that is not user-submitted — including but not limited to the TucsonArtisans.com name, logo, site design, graphics, and written content — is the intellectual property of TucsonArtisans.com and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or use any of our proprietary content without express written permission.
Disclaimer of Warranties
TucsonArtisans.com is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not endorse or guarantee the accuracy of any listing, event, Contest entry, or user-submitted content on the Site. Your use of the Site is entirely at your own risk.
Limitation of Liability
To the fullest extent permitted by law, TucsonArtisans.com and its owners, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Site, including but not limited to damages arising from listing inaccuracies, event cancellations, Contest participation or outcomes, reliance on user-submitted content, or interruption of service. Our total liability to you for any claim arising from use of the Site shall not exceed the amount you paid to us, if any, in the twelve months preceding the claim.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Arizona, United States of America. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts located in Pima County, Arizona.
